Here is Article 53 of RA 7394 (Under the TITLE III. – PROTECTION AGAINST DECEPTIVE, UNFAIR AND UNCONSCIONABLE SALES ACTS OR PRACTICES, CHAPTER I: DECEPTIVE, UNFAIR AND UNCONSCIONABLE SALES ACTS OR PRACTICES):

Article 53. Chain Distribution Plans or Pyramid Sales Schemes. – Chain distribution plans or pyramid sales schemes shall not be employed in the sale of consumer products.

Article 4 defines certain terms…

k) “Chain distribution plans” or “pyramid sales schemes” means sales devices whereby a person, upon condition that he makes an investment, is granted by the manufacturer of his representative a right to recruit for profit one or more additional persons who will also be granted such right to recruit upon condition of making similar investments: Provided, That the profits of the person employing such a plan are derived primarily from the recruitment of other persons into the plan rather than from the sale of consumer products, services and credit: Provided, further, That the limitation on the number of participants does not change the nature of the plan.

So, is First Vita Plus just one big pyramiding scam?

No, it is not.

When you successfully invite someone to become a dealer, that person will pay First Vita Plus around P7,700 for P9,240 worth of products.

For that, you will earn a commission of P500. Afterall, you helped the company make a P7,700 sale.

[Yes, the P6,999 price will go up to P7,699 starting March 2010]

If you invite two people, you will earn P1,000 (P500 x 2), and since they’re a pair, you also have the chance to earn another commission of P1,500 (depending on where you place those people in your team).

Again, you made sales, so you earn a commission.

And yes, you can end up earning more than the person who invited you to become an FVP dealer, because you have the power to outsell your sponsor.

Here’s the key point, though:

There are other ways to earn via First Vita Plus.

I know a First Vita Plus dealer who isn’t actively inviting people to sign up as dealers under her. What she does instead is she directly sells First Vita Plus products to people she knows.

As an FVP dealer, she buys FVP products at a 25% discount and sells those products at regular suggested retail prices.

While she has around 5 dealers under her, those dealers are not actively recruiting. In other words, her FVP monthly income comes purely from direct/retail sales.

The people who buy the First Vita Plus natural health drink products from her have no desire to become dealers. They do not wish to invite others to become dealers.

They simply want to buy and consume the products, not as FVP dealers or discount club members. They don’t want to enjoy the 25% discount.

They just want to be regular FVP customers.

In other words, there are people who want to buy the products even if there is no compensation plan whatsoever.

One person mentioned that according to the Direct Selling Association of the Philippines (DSAP), companies using a binary compensation model are illegal.

Please show us the DSAP article that says that.

We searched the DSAP website (http://www.dsap.ph) but did not find any article that states that MLM companies using the binary method are automatically illegal.

There are a some people who have a certain view of binary plans, network marketing, or MLM companies mainly because they lack the training on how to make it work.

Hello! You’re about to gain a clearer understanding
of how you can earn with First Vita Plus, as much as
P15,000 a day, or P75,000 a week, or P300,000 a month.

The First Vita Plus plan begins with YOU.

Let’s say you successfully invite two people.
For example, Kris and Vi (not their real names).

First Vita Plus Compensation Plan - Two People

You can place up to a maximum of two people
directly under you. But you can invite as
many people as you want.

Since you were the one who invited Kris and Vi,
and since they signed up as First Vita Plus dealers,
you will earn a Direct Commission of P500 for each successful invite.

Direct Commissions and GSOC

You can now choose where to position the people you
invited in your team.

Let’s assume that you place Kris on the left side,
or in Sales Group A, and Vi on the right side, or
Sales Group B.

Since you have a matching pair (Kris and Vi, one on the left
matches one on the right), you will also earn a
Group Sales Override Commission or GSOC of P1,500.

Let’s assume you once again successfully invite other
people. For example, your Kuya and your Tita.

Please note that since you already have two people
right under you (namely Kris and Vi), you will need to place
your Kuya and your Tita in a new slot.

You can place your Kuya and Ate under anyone who's under you.

In this example, since Kris and Vi have not successfully
invited anyone, you can place your Kuya under Kris (if you wish)
and your Tita under Vi (again, if you wish).

Please coordinate first with your downlines, Kris and Vi,
before placing people you directly invited under them,
because Kris and Vi might wish to use the 3-head approach.

(That technique will be explained in another tutorial called the
First Vita Plus: 3-Head Strategy).

Anyway, let’s get back to the discussion…

Did you notice how YOUR efforts are helping your downlines
Kris and Vi? It was you who directly invited your Kuya and
Tita, but based on the chart, your Kuya and Tita and under
Kris and Vi.

That means that if Kris directly invites just one more person,
she will have a pair of people under her. The same thing goes
for Vi. She only has to invite just one more person to have a pair
of people under her.

So, since you directly invited your Kuya and your Tita, you will earn
a Direct Commission of P500 for successfully inviting them. Even if they
are assigned under Kris and Vi, you get the Direct Commission of P500
because it was you who directly invited them.

First Vita Plus Commissions and Gross Sales Override Commissions

Notice also that you once again have a pair: Your Kuya is in Sales Group A
(or the left side), and your Tita is in Group Sales B (or the right side).

Since you have a match, you also earn a Group Sales Override Commission
or GSOC of P1,500.

Now let’s suppose Kris directly invites James to be a First Vita Plus dealer,
while Vi invites Ralph.

People under you earn commissions when they directly sponsor new dealers.

As a result, Kris earns a Direct Commission of P500.
Vi also earns a Direct Commission of P500 because she directly invited Ralph.

Notice that you previously placed your Kuya under Kris, and your
Tita under Vi.

Even if they invited only one person, they can still earn a GSOC because a pair is formed.

Because of the Kuya-and-James pair or match under Kris, Kris will
earn a Group Sales Override Commission or GSOC of P1,500.

And because of the Ralph-and-Tita pair or match under Vi, Vi
will also earn a GSOC of P1,500.

Do you now see how your efforts as the upline of Kris and Vi
are helping them earn a GSOC?

That’s an example of how First Vita Plus dealers help one another.

Please take note that you directly invited Kris and Vi. That makes
them part of your First Level. We’re not talking about positions
in the chart right now.

A First Level refers to the person you directly invited, such as
Kris, Vi, your Kuya, and your Tita. Those four people (in the blue
circles) form part of your first level.

When people in your First Level invite others, such as James and
Ralph, or the ones in the red circle, those people represent your
Second Level.

You earn a Sales Override Commission (product voucher)

In this example, because Kris brought in James, you will earn
a Sales Commission equivalent to a P350 product voucher. You will
also earn a P350 Product Voucher because one of your direct invites,
or direct dealers, specifically Vi, successfully invited Ralph.

In addition, please notice that thanks to the help of your downlines
Kris and Vi, another pair or match has formed under you.

You earned another GSOC

James is part of your Sales Group A (or your left side), while Ralph
is part of your Sales Group B (or your right side).

You therefore earn a GSOC of P1,500 because of the match formed
by James and Ralph.

Did you catch that? You earned P1,500 because of the efforts
of your downlines.

It’s only fair, right? Earlier, you helped your downlines when you
placed your Kuya under Kris, and your Tita under Ate Vi. You helped your
downlines earn their GSOC earlier.

Later on, your downlines helped you earn a GSOC also. That’s proof
that in First Vita Plus, we help one another.

Now what happens if James invites Joshua, and Ralph invites lucky.

You once again earn another GSOC

Do you see another pair or match? Yes, Joshua is in your Sales
Group A (or left side), while Lucky is in your Sales Group B (or
right side). Because of the match, you again earn a GSOC of P1,500
for that pair.

James and Ralph will each earn a direct commission of P500 because
they were the ones who directly invited Joshua and Lucky.

Kris and Vi will each earn a P350 product voucher, because the
dealers they directly invited, specifically James and Ralph,
each invited new dealers.

Now what happens if Lucky directly invites two people, represented
by the yellow circles?

Following the pattern, Lucky will earn a direct commission of P500
for each of his direct invites. In this case, since he invited two
people his total direct commission is P1,000 or P500 times 2.

Lucky will also earn a GSOC of P1,500 because there is a pair or
match under him.

Ralph will earn two product vouchers each worth P350, for a total of
P700 in product vouchers, because his direct dealer, Lucky, directly
invited two new dealers.

Please notice that those two yellow circles are both in your
Sales Group B, or your right side. There is no match on your
left side.

Potential GSOC earnings

In other words, those two new dealers are called “WAITING.”

They are waiting for a match on the other side.

For example, if your Kuya directly invites a new dealer, or if you
directly invite a new dealer and place that new person under your
Kuya, that new person (represented by the circle with blue diagonal
lines) will match with one of the people directly invited by Lucky.

Or if James directly invites a new dealer, that new person will be
considered a match with one of the people Lucky directly invited.

And with each match, you earn a Group Sales Override Commission or
GSOC of P1,500.

Of course, you can go ahead and directly invite new dealers, and then
just place those new dealers under your Kuya, or under James, or even
under Joshua.

Yes, you can help your downlines out.

In the true essence of network marketing or multilevel marketing, however,
it would be wonderful if you can train and motivate your downlines to
become successful when they directly invite, train, and motivate others.

Please note that the maximum matches per day is 10 matches. At
P1,500 per match, that’s a maximum of P15,000 a day, which is
equivalent to P75,000 a week, or P300,000 a month.

How much refined sugar does our body need?

Here’s how to mix your natural health drink:

Some sponsors will tell new or potential FVP dealers that they can earn more by having 3 heads instead of just one dealership account.

Since the maximum earnings per month (in terms of Gross Sales Override Commissions) is P300,000 then having 3 accounts will, theoretically, help you reach a maximum of P900,000 (in GSOC) monthly.

Let’s say your upline gets you to sign up as an FVP dealer, and you invest P6,999 in exchange for 12 boxes [20 sachets per box] of First Vita Plus natural health drink (retail value of P8,400).

In that transaction, your upline will earn a Direct Commission of P500 (less taxes), while your upline’s upline will earn a product voucher worth P350 (which is actually a box containing 10 sachets of First Vita Plus).

So, when you (as new dealer) adopt the 3-head strategy, you will invest in two more First Vita Plus Power Packs (P6,999 x 2 = P13,998).

Simply place those two additional dealership applications under you (or under your first dealership account), and you will each P1,000 in direct commissions (P500 x 2), less withholding taxes.

In that transaction, your upline will earn two product vouchers totaling P700 (P350 x 2), which translates to two boxes (10 sachets per box) of First Vita Plus.

In addition, since you placed your 2nd and 3rd application under you (one of your left side or Sales Group A, and the other on your right side or Sales Group B), you will earn a Group Sales Override Commission of P1,500 (less a 10% withholding tax, and less P525 worth of product).

You will earn a GSOC for your 2nd and 3rd heads, because number 2 and number 3 will form a “match” under you.

Please note that your upline will NOT have a “match” because your three accounts are all located in just one side of your upline (either on the left or A side, or on the right or B side).

What exactly does your upline earn if you do the 3-Head Strategy?

For your first account – Upline earns cash of P500 (less withholding tax).
For your 2nd account – Upline earns P350 product voucher.
For your 3rd account – Upline earns P350 product voucher.

So the total earnings of your upline (assuming you adopt the 3-Head approach) will be a net cash check of P450 (P500 less 10%), plus two 10-sachet boxes.

If you just open ONE dealership account, then your upline will earn only P450.

Why do some uplines encourage a 3-head strategy?

Well, if they invite two dealers and place one on the left side, and the other on the right, and if those two dealers both adopt the 3-head strategy, then the upline will earn a GSOC of P4,500 (P1,500 x 3 pairs), which is subject to withholding tax and the P525 product conversion.

Compare this with a GSOC of only P1,500 if the upline invites two dealers who simply use the 1-head approach.

Some of you might be saying: “First Vita Plus MLM is just a scam!”

Please, it is not. Especially if the person sponsoring you clearly explains why the 3-Head Strategy is a good approach for those of you who are more entrepreneurial, and if that sponsor clearly discloses how much he or she will earn (or will potentially earn) as a result of you investing in three First Vita Plus Power Packs.

If you are committed to directly sponsoring 12 people, as well as train and motivate them (if they want to be dealers), or build a business relationship with them (if they want to be retailers), then you might wish to seriously consider the 3-Head Strategy for your network marketing business.

So why are some dealers showing checks in excess of P300,000 a month? Some have shown P400,000 checks, and others have even claimed P800,000+ per month?

They achieved that using the 3-Head Strategy. Here’s an example of what your chart can look like over time…

First Vita Plus 3-Head Strategy

The 3-Head Strategy is used by people (new dealers) who sign up for three accounts in their name. For example,

(YOU) Juan Santos Dela Cruz
(YOU #2) Juan S. Dela Cruz
(YOU #3) Dela Cruz, Juan Santos

Next, they build the network of people (both left and ride side) under You #2, and also under You #3 (both left and ride side).

Over time, and if you speak with and connect with as many people as you can (face to face or through the internet), it is possible to reach a point where in a given month, You #2 will have 200 new dealer sign-ups on his left side, and another 200 also on his right side.

In such a case (about 10 new dealer sign-ups per day per side), You #2 will have 200 sign-up pairs or matches in that month. Multiply the number of matches by the Group Sales Override Commission of P1,500 per match and you arrive at a P300,000 target for that month.

Those same computations can apply when the network under You #3 gets 200 new dealer sign-ups for the month (staggered at a 10 sign-ups per day) each for the left and the right side. That’s how you get your second P300,000 for the month.

In other words, you need to build the communities under both You #2 and You #3. When you assign four highly motivated people under You #2 and You #3, your task will be easier.

Afterall, that is the essence of network marketing: Duplicate yourself by training other people to do what you do.

Remember the “YOU” above You #2 and You #3? Although you can see from the chart the “YOU” will have 400 pairs (200 pairs under You #2 plus 200 pairs under You #3), the maximum GSOC payout rule of 10 matches per day means “YOU” will earn at most P300,000 in Group Sales Override Commissions.

Since those three accounts belong to “Juan Santos Dela Cruz”, those three separate checks will in effect be a monthly earnings goal of P900,000.

Initial investment = P6,999 x 3 = P20,997
Direct Commission of YOU = P500 x 2 = P1,000 less tax = P900
1st GSOC of YOU = P1,500 (for the YOU#2 and YOU#3 pair)
GSOC less 10% tax = P1,350 (GSOC net of withholding tax)
GSOC net of tax, less P525.00 product = P875 net GSOC

(NOTE: There are rules regarding product movement, so please expect a product deduction of P525 from each check containing GSOC payouts. You will get one box of the product in exchange for that P525 deduction.)

In effect, your net initial investment is P20,997 less P900 (net DC), less P875 (net GSOC), which comes out to only P19,272 (after you encash your commission checks).
